Terms and Conditions

By paying any part of your deposit or invoice, you are agreeing to the following:

- All sessions require a deposit at the time of booking. Until this deposit is paid, the session is not confirmed, and the date is still available for others to book.

- The invoice must be paid in full no later than the day before the session, or the session may be cancelled and the deposit not refunded.

- Unless explicitly discussed and agreed upon in writing, neither Tyler Garcia, nor 33rd Street Studio makes any claim of ownership or future royalties earned off any music created at 33rd Street Studio.

- Each song or album's credits shall, in the case of mixing, read "Mixed by Tyler Garcia at 33rd Street Studio" on all platforms, including printed on physical media and credited when listing music to streaming services.

- Each song or album's credits shall, in the case of engineering, read “Recorded by Tyler Garcia at 33rd Street Studio" on all platforms, including printed on physical media and credited when listing music to streaming services.

- Each song or album's credits shall, in the case of producing, read “Produced by Tyler Garcia at 33rd Street Studio" on all platforms, including printed on physical media and credited when listing music to streaming services.

- Each song or album's credits shall, in the case of co-writing, read “Written by *ARTIST* and Tyler Garcia at 33rd Street Studio" on all platforms, including printed on physical media and credited when listing music to streaming services.

- Sessions 5 hours or less require 100% payment up front.

- Sessions longer than 5 hours require a deposit to hold the date. The remainder is due no later than the day before the session.

- If you booked a session that is less than a full day, the entire balance is due no later than one week before the session. If your session is booked inside of a week, payment is due in full at the time of booking. Until the balance is paid, your date is not locked in and not confirmed.

- Payment is due in full before any files or mixes are released.

- Cancellations less than 7 days before the session will not receive a refund.

- The session, and the billable time begins at the agreed upon time.

- 33rd Street Studio is non smoking.

- Please inform us if you would like to bring guests to the session that are not directly involved in the production.

- If you want to retain a copy of the master recordings, including multi track audio, please bring with you a USB hard drive that is formatted for use with macOS, or one that you are comfortable being erased. Otherwise, the approved masters will be delivered only as stereo WAV and mp3 files via electronic delivery.

- Stems and standard alt mixes are included by request at no cost in the mixing fee. Standard alt mixes that are included are "TV Mix" and "Instrumental Mix".

- Your personal data, including your email address will be kept private and will only be used to send invoices and occasional studio updates.

- Your session data and all audio files will be kept private and not shared before your designated release date without your consent.

By paying any part of your deposit or invoice, you are agreeing to these terms and conditions.
